1. The Service

everything.fun is an AI-powered platform that lets users generate, preview, and deploy websites and applications, and access related creator tools. Features may change, expand, or be discontinued at any time.

2. Eligibility & Accounts

You must be at least 18 years old and legally able to enter into these Terms. You are responsible for activity under your account and for keeping your credentials and wallet secure.

3. Credits & Payments

• The Service uses prepaid credits to access AI generation, deployment, and other paid features. Each paid action decrements your credit balance.
• You may purchase credits (“top-ups”) by card or cryptocurrency through third-party payment processors. Those processors handle payment collection and any required identity verification under their own terms; we do not store your card or bank credentials.
• Credits have no cash value, are for use within the Service only, and are non-refundable except where required by law.
• Prices and credit costs may change. Applicable taxes are your responsibility.

4. Acceptable Use

You agree not to use the Service to:

• violate any law or third-party right, including intellectual-property and privacy rights;
• create or distribute malware, spam, phishing, or fraudulent, deceptive, or harmful content;
• infringe, impersonate, or misrepresent your affiliation with any person or entity;
• attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its infrastructure;
• abuse credits or payment flows, including chargeback fraud.

5. User Content & AI Output

You retain ownership of the content and projects you create. You are solely responsible for your prompts, content, and anything you deploy. AI-generated output may be inaccurate or unintended; you must review it before relying on or publishing it. You grant us a limited license to process your content solely to operate and improve the Service.

6. Cryptocurrency & Blockchain Risks

The Service interacts with public blockchains and digital assets. Blockchain transactions are irreversible and outside our control. Digital assets are volatile and may lose value. Nothing on the Service is financial, investment, legal, or tax advice, and we do not act as a broker, exchange, or custodian of your assets. You are solely responsible for your transactions, wallets, and compliance with applicable law.

7. Third-Party Services

The Service integrates third-party providers (authentication, payments, hosting, AI, and blockchain infrastructure). We are not responsible for third-party services, which are governed by their own terms and policies.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOKEN MEDIA, LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR DIGITAL ASSETS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You will indemnify and hold harmless Token Media, LLC from claims, damages, and expenses arising from your use of the Service, your content, or your violation of these Terms or applicable law.

11. Termination

We may suspend or terminate your access at any time for any reason, including violation of these Terms. Provisions that by their nature should survive termination will survive.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.

13. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
